In accordance with the federal Stop Campus Hazing Act, this page provides information on hazing prevention efforts, reporting procedures, and public access to the Campus Hazing Transparency Report (CHTR) and related resources.
The Texas Education Code includes specific provisions regarding hazing in Chapter 37, Subchapter F (Sections 37.151 through 37.157).
- Definition: The code defines hazing as any intentional, knowing, or reckless act occurring on or off a school's campus directed against a student that endangers their mental or physical health or safety for the purpose of pledging, initiation into, affiliation with, or maintaining membership in an organization.
- Personal hazing offense: A person commits an offense if they engage in hazing, encourage hazing, permit hazing to occur, or have firsthand knowledge of hazing and fail to report it to appropriate school officials.
- Organizational hazing offense: An organization commits an offense if it condones or encourages hazing, or if an officer authorizes, requests, or assists in hazing activities.
- Consent not a defense: It's explicitly stated that a person's consent to being hazed is not a defense against prosecution.
- Penalties: Hazing offenses range from Class B misdemeanors to state jail felonies, depending on the severity and whether serious bodily injury or death resulted.
- Reporting requirements: Educational institutions must publish summaries of the hazing law and develop rules prohibiting hazing, with enforcement procedures.
- Immunity for good faith reporting: The code provides immunity from civil or criminal liability for persons who report hazing incidents in good faith.
If you witness or experience hazing, report it immediately. Coastal Bend College prohibits hazing in all forms, with or without the student’s consent. Reporting is confidential and may be submitted anonymously. Your report helps keep our campus safe.
